1. Acceptance of these terms

By downloading, installing, or using Human OTP (the "App"), you agree to these Terms of Service (the "Terms"). If you don't agree, please don't use the App. Because the App has no accounts and no sign-up, your use of it is your acceptance of these Terms.

2. What Human OTP is

Human OTP is a free consumer utility that helps two people who have paired in person confirm they are really talking to each other. After an in-person QR pairing, each person's device independently shows a matching rotating code that they can read to one another to check identity. The App also works as a standard TOTP two-factor authentication (2FA) authenticator for generating login codes for websites and apps you add. The App runs on your device; your contacts, pairing secrets, and 2FA keys are stored on your device as described in our Privacy Policy.

3. A safety aid, not a guarantee

Human OTP is a tool to help you make a better judgment — it is not a guarantee of anyone's identity, honesty, or safety. A matching code indicates that the other party holds a secret you exchanged in person during pairing. It does not, and cannot, prove intent, prevent coercion, or confirm the truth of anything said on a call.

• A matching code can be defeated if a paired person's device is lost, unlocked by someone else, or controlled under duress.
• A non-match may simply be a mistake (a mistyped or misread code) rather than proof of fraud.
• The App cannot verify anyone you have not paired with in person.

Always use your own judgment. Do not rely on the App as your sole basis for high-stakes decisions such as sending money, sharing sensitive information, or acting on urgent requests. If something feels wrong, stop and verify through another trusted channel.

4. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or to harass, defraud, impersonate, or harm anyone.
• Attempt to reverse engineer, decompile, or interfere with the App except to the extent the law expressly permits.
• Disrupt, overload, probe, or abuse the pairing relay or any related infrastructure, or use it other than as the App is intended to use it.
• Use the App to violate the rights (including privacy rights) of others, or to share another person's details without their consent.
• Use the App in any way that violates applicable laws or the terms of the app store you installed it from.

5. Your responsibilities

You are responsible for your device and its security — including keeping your operating system up to date, using a device passcode and biometric lock, and enabling the App's App Lock if you want an extra layer. Because your contacts, pairing secrets, and 2FA keys are stored only on your device, they can be lost if you lose, reset, or fail to back up your device, and they may be exposed if someone else gains access to an unlocked device. You are responsible for pairing only with people you trust and for deciding what optional information (name, phone, email, note) to include in your pairing code, which is visible to anyone who scans or sees it.

6. Price and availability

The App is provided free of charge. We may change, suspend, or discontinue the App or any part of it (including the pairing relay) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the App. Nothing in these Terms obligates us to provide updates, support, or continued availability.

7. Intellectual property

The App, including its name, design, and software, is owned by its developer and protected by intellectual-property laws. Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. These Terms do not transfer any ownership rights to you.

8. No warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that it will detect or prevent impersonation, fraud, or any other harm. To the fullest extent permitted by law, you use the App at your own risk.

9. Limitation of liability

To the fullest extent permitted by law, the developer of the App will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, loss of trust, or financial loss, arising out of or related to your use of (or inability to use) the App — including any reliance on a matching or non-matching code — even if advised of the possibility of such damages.

Because the App is provided free of charge, to the extent any liability cannot be excluded, the developer's total aggregate liability arising out of or related to the App is limited to US $0 (or the minimum amount required by applicable law). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, liabilities, and expenses arising out of your misuse of the App or your violation of these Terms or applicable law, to the extent permitted by law.

11. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above and post the new version here. Your continued use of the App after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-laws rules, and any disputes will be resolved in the courts located there — except where applicable law gives you the right to bring a claim in your local jurisdiction.
